PERSONAL DATA PROCESSING NOTICE

1.Responsible for Processing of Personal Data

3. Purpose of Processing

  • 3.1. Providing medical monitoring assistance for patients with scoliosis through the use of the "Scoliosense" application/platform.
  • 3.2. Medical monitoring is carried out only by the treating physician of the subject, to whom the subject's personal data are transmitted and who conducts further processing as the Controller.
  • 3.3. Conducting scientific research on the proper use and application of the support brace for treating scoliosis through medical tests.
  • 3.4. The statistical analysis of medical monitoring.

4. Legal basis of processing

4.1. The processing is necessary for the fulfillment of a service contract between the user of the application/platform "Scoliosense" and the controller providing the application/platform (Article 6 (1b) GDPR).

4.2. The processing is necessary for preventive or professional medicine purposes (Article 9 (2) GDPR) and is carried out under the responsibility of the subject's treating physician (Article 9 (3)) and the columnar manufacturer, who carry out further processing for which they themselves are Responsible.

4.3. The processing is necessary for archiving purposes in the public interest, for scientific or historical research purposes, or for statistical purposes (Article 9 (2) GDPR).

4.4. For Swiss residents, processing is based on your consent and on overriding private interests in providing and improving medical monitoring services, in accordance with the Swiss Federal Act on Data Protection (revFADP).

5. Personal Data Collected

  • 5.1 Name
  • 5.2 Surname
  • 5.3 Biological gender
  • 5.4 Home Address-Location-Time Zone
  • 5.5 Date of Birth
  • 5.6 Username (if identifiable)
  • 5.7 E-mail (In case this is identifiable personal data)
  • 5.8 Health and genetic data, such as type of scoliosis, Cobb angles, Skeletal Maturity Scale, weight, height
  • 5.9 Health data obtained from column sensors, including sensor count, names, and values
  • 5.10 User's mobile phone number or, in the case of a minor, the mobile phone number of the person exercising his/her parental responsibility

6. Recipients

  • 6.1 The Data Controller and its employees.
  • 6.2 External partners of the Controller (in particular cloud service provider Microsoft Azure).
  • 6.3 The personal data of the subjects are transmitted to the user of the application/platform - attending physician of the Subject and to the user of the application/platform - manufacturer of the column, who further process the data of the Subject, for which they themselves are responsible.
  • 6.4 The personal data of the subjects are not transferred to third parties other than the above, nor to a third country or international organization.
  • 6.5 All personal data is stored and processed within the European Union/EEA, which is recognized by the Swiss Federal Council as providing adequate protection.

7. Storage period

7.1 Personal data (common or special category) is retained for as long as necessary for monitoring by the clinician and in any case for the entire period that the subject uses the application, as well as for 30 days after its deactivation.

7.2 Non-identifiable statistical data shall be retained for 20 years after collection.

You hereby declare that you fully understand the above and have been informed about the processing of your Personal Data (including special categories of data) which is a necessary condition for the use of the application/platform "Scoliosense", as well as about the pseudonymised publication and presentation of scientific research results.

Additional Information for Swiss Residents

For residents of Switzerland under 16 years of age, consent must be provided by a parent or legal guardian.

In case of a personal data breach, we will notify the competent authority and, where necessary, affected individuals as soon as possible, in line with Swiss law.
